New rules ease liability concerns when designing pools in B.C.

The Association of Professional Engineers and Geoscientists of B.C. (APEGBC) has developed a new document governing the construction and operation of swimming pools.
The document, British Columbia Pool Regulation Statement of Compliance, was developed jointly with the B.C. Ministry of Health. It was deemed necessary because previously there were no standardized rules between the six regional health authorities.
APEGBC says that some health authorities were creating their own forms with “language that goes beyond the requirements of Section 6(2)(a)(i) and includes wording that could potentially
– void the insurance policy of the engineer or architect; or
– make an engineer or architect liable for conditions pertaining to the operation of the pool and over which an engineer or architect has no control once the control of the construction pool has been passed to the pool owner.”
The Ministry obtained the agreement of the six provincial health authorities on the standardized wording and format of the new form. APEGBC’s Council endorsed the compliance statement in April. Endorsement is also being sought from the Architectural Institute of B.C.
